Appraisals Across Cobb County

Cobb has seven cities and a large unincorporated remainder, federal land in three parts of the county, private lakes owned by homeowners associations, and a Board of Equalization that answers to the Clerk of Superior Court rather than the assessors. My Marietta and Acworth pages cover those two markets. This page covers the county itself.

Seven cities and the unincorporated rest

Cobb's cities are Marietta, the county seat, along with Smyrna, Kennesaw, Acworth, Austell, Powder Springs, and Mableton, the newest. A great deal of the county's housing sits in none of them. Cobb's own boundary data puts Indian Hills and Chimney Lakes in east Cobb, and Brookstone in the west, outside every city line, while Vinings Estates falls inside Smyrna and Whitlock Heights inside Marietta.

The line matters to value in practical ways. A city parcel can carry a city levy and city services on top of the county's, and its zoning questions go to a different government. Two houses a mile apart can look like the same product and carry different costs of ownership, so a careful comparable analysis notes which side of the line each sale sat on.

Federal land in three parts of the county

In the north, the Corps of Engineers manages the Allatoona and Lake Acworth shorelines, and a dock there rests on a federal permit that does not transfer when the house sells. My Acworth page covers that in detail.

In the middle of the county, Cobb's parcel records show neighborhoods such as The Heritage at Kennesaw Mountain and Mountain Walk platted directly against the National Park Service land of Kennesaw Mountain National Battlefield Park. In the southeast, Sibley Forest and Terrell Mill Estates back onto the Chattahoochee River National Recreation Area. Permanent public open space behind a house is a genuine influence on value, and it is also a hard boundary. An adjoining owner has no right to clear, build on, or extend a yard onto park land, and a report should describe the parcel where it legally ends, not where the lawn stops.

Private lakes are a different problem

Not every Cobb lake is federal. The county's lake inventory lists the two lakes at Chimney Lakes and the two at Chimney Springs, both in east Cobb, under private jurisdiction, and Cobb's parcel records show a parcel of about 59 acres at Chimney Lakes owned by the homeowners association. On water like that, who may use the lake, who may build a dock, and who answers for the dam are questions for the plat, the recorded covenants, and the association, not the Corps.

That changes what I read before I value the house. On a Corps lake the controlling document is a federal permit. On a private subdivision lake it is the declaration and the association's rules, and the cost of keeping the lake can land on the owners. Neither kind of water can be valued from a listing photo.

Club communities: the course is not the membership

Some of the largest subdivisions in Cobb's records were laid out around a club. In west Cobb, the Marietta Country Club subdivision surrounds a parcel of about 160 acres held by the club itself, and Brookstone is platted around the course of the private Brookstone Golf and Country Club.

Course frontage and course views are measurable influences, and they are uneven within a neighborhood. A lot on a fairway, a lot across the street, and a lot at the back of a cul-de-sac do not share a comparable pool because they share a name. Membership is a contract, not real estate, so the appraisal identifies what the property conveys and leaves the membership where it belongs.

What the Board of Equalization will look at

Cobb moved oversight of its Board of Equalization from the assessors' office to the Clerk of Superior Court effective January 1, 2011, after a 2010 change in state law. Board members are Cobb property owners appointed by the grand jury for three-year terms, and each completes forty hours of training before deciding appeals.

The clerk's own guidance says two things every appellant should take seriously: all property is valued as of January 1, and only sales before January 1 of that year will be considered at the hearing. An argument built on a spring sale is not evidence this board will weigh. An owner may be represented at the hearing by an appraiser, with written notice at least 48 hours ahead and a signed letter of authorization. A board decision can be taken to Cobb Superior Court by filing a notice of appeal with the Board of Tax Assessors within 30 days.

The original appeal still goes to the Board of Tax Assessors within 45 days of the notice date under O.C.G.A. 48-5-311.

Estates in Probate Court, divorce in Superior Court

Estate work in Cobb runs through the Cobb County Probate Court in Marietta, which oversees the administration of estates and guardianships. An executor or administrator there usually needs a value as of the date of death, and in a county with this many sales the hard part is not finding comparables but excluding the ones from the wrong submarket.

Divorce belongs to Superior Court everywhere in Georgia. The state constitution gives the superior courts exclusive jurisdiction over divorce cases and over cases respecting title to land, so a disputed marital home in Cobb is argued in Cobb Superior Court. My reports for either court are written to be cross-examined, with the effective date set by the matter.

Working Cobb from Cartersville
